“Vehicle &” or “Vehicle And” is an electronic Platform, owned by and affiliated to Mastering Intelligent Solution Group LLC, a sole proprietorship, CR. No. 2050134149. The Platform gives the visitors and users an access to advertising for the sale of vehicles and exhibiting advertisements. This page highlights the conditions of the Platform use, whether as a visitor or a browser of the content or as a registered user. Before starting the use of the Platform, please read the use conditions carefully.
1. Definitions of the Agreement of Vehicle &
Whenever referred to herein, the following terms shall have their corresponding meanings:
1. Mastering Intelligent Solution Group LLC, a sole proprietorship, CR. No. 2050134149, its address is in Eastern Province, Kingdom of Saudi Arabia. It is the owner of the website www.vehicleand.com or www.vehicleand.sa and mobile applications in IOS and Andriod operating systems, it is a Platform which gives the user an access to advertise, purchase and of vehicles according to the definite terms and conditions and under the user's liability.
2. Agreement: this agreement, the agreement of terms and conditions, which include the terms and controls of using the Platform, regulating the relationship between all parties concerned. Apart from the other policies on the Platform, it includes the conditions which we provide for you for having an access thereto or use thereof.
3. Platform: it is the website of “Vehicle &” www.vehicleand.com and www.vehicleand.sa including its mobile applications, which shall be referred to hereafter as "(Vehicle And) ", or "(Vehicle &)," the "Platform" ,"application" or the "website", "We", " for us", or " www.vehicleand.com) or "the Services"
4. The User: any natural or juristic entity, whether an individual, corporation or company, which have an access to or use of the Platform and direct or indirect user of its services, which shall be referred to as the member or user, whether an advertiser or browser.
5. Advertiser: it is the user of the Platform for advertising who or which shall be liable in terms of the content, for the correctness of its information and compliance with terms and conditions of the content as stipulated by the Platform, including the liability for its consequences and damages.
6. Content: any material which is published in “Vehicle &” Platform.
1. Your use or continuous browsing of the Platform shall be deemed an unconditional approval of this agreement. Upon access /registration or continuous use of the Platform, you shall promptly agree to comply with the conditions, terms or legal documents which are referred to herein otherwise, you shall not be permitted to use the Platform and browse the content.
2. Your reading of the terms and conditions in “Vehicle &” Platform shall be deemed as information for complying and agreeing with the terms of its use. These terms shall be made available for all the visitors and subscribers for their review.
3. The Platform shall be entitled to amend the agreement or any of its provisions, or add new provisions. The updated version of the Platform shall be published. Your continued use of the Platform shall be deemed an agreement to its updated provisions.
4. The user declares that the user is exclusively liable for all the information which the user sends or publishes. The role of Platform is limited to presenting this information on its pages and through its media channels.
5. The user shall not perform any actions which may have detrimental effect on the Platform or its infrastructure. In case of violating this item, the user shall pay the compensations due to any likely damages.
6. The user shall not publish or upload any defamatory, provocative, transgressive, harmful, threatening, offensive, manipulative, racist, unethical materials or any unproper or illegal contents or information.
7. The user shall not have an access to the Platform by illegal methods or give any third parties an access to the use of one's account or manipulate the membership with any third person. In case of any violations, the user shall be accountable before the security authorities or for any consequential damages.
8. In case of the user's violation of any of these conditions, at the sole discretion of the Platform, the Platform shall be entitled, with no prior notice, to erase any published content or demands, suspend or limit the user's access to the Platform or report the user to the internet service providers or the competent authorities or taking any legal measures.
9. The Platform may give the user an access to creating and reviewing the advertisements. The Platform is not sales hub or authenticator of any published advertising content. The user shall ascertain the soundness or credibility of any added advertisement or of the adverting person.
10. The user warns its users upon the sale or purchase of any vehicle on the Platform, its role, in such case, is limited to providing an access for the users to publishing their advertisements.
11. The Platform shall not conclude any sale, purchase or brokerage transactions as this is the direct and formal role of the users.
3. Rights of Property of Mastering Intelligent Solution Group, LLC, CR. No. 2050134149.
1. The trademark “Vehicle &” , owned logos and the other words, and logos on the Platform are protected by the rights and laws of the property of the other local and international trademarks and intellectual property.
2. All other trademarks which are not the property of “Vehicle &” and published or shared on the Platform are the property of their owners who or which may not be subordinate to or sponsored by “Vehicle &”.
3. You agree, subject to these conditions, that the Platform, its subordinates or owners as the case may be, are the exclusive owner of its (or its authorized user) intellectual property rights and the Platform is compiling entity and is exclusively owned by Mastering Intelligent Solution Group LLC. It is the exclusive user of the content and is protected by virtue of the laws and conventions of copyrights worldwide.
4. The rights of intellectual property of the famous trademarks which are shared on the Platform for advertising or marketing for the famous auto companies or their agents or distributors are not included in the rights of intellectual property herein.
5. You shall not be entitled to a copy whichever is protected by the rights of intellectual property on the Platform or content, distribute, reproduce, sell, lease, transmit or license any third party to use or withhold it. In case of violating this condition, you shall be exclusively accountable for any consequential damages.
6. The logo “Vehicle &” and all the membership logos on the Platform are exclusive trademarks which are registered and protected according to the laws of protecting the intellectual property and trademarks.
7. The design form of the Platform shall not be copied or reproduced in any other Platform.
8. You shall not amend any item on the Platform or content or make any derivatives thereof except in respect of your own content.
9. You shall not collect or use any information of any third parties on the Platform including addresses of their emails, telephones or addresses without their approval.
10. You shall not disintegrate or analyze, change or recheck any source code on the Platform or any software or database therein.
11. The user shall not take action which may cause or be contradictory to the rights of the intellectual property of the Platform or any third party.
12. The user shall not upload or attach any files or software or any materials which are protected by laws of the intellectual property rights or ay other private or public rights which the user is prohibited of having rights of their use.
13. The advertiser is aware that by advertising on the Platform, its means of communication shall be shared by all its users and visitors.
4. Content of the Platform
Upon publishing any content on the Platform, you shall confirm the following:
1. The Platform shall have unlimited and irrevocable right which is free of any expenses or fees of property rights or obligations which may be provided to any third party and shall be licensed for its regular use, copy, reproduction, distribution, presentation or extraction.
2. The Platform shall be entitled to execute or amend any information, personal materials or any advertising content which you provided the Platform with for registration or advertising on the Platform through any use or sharing available methods, whether they are the relevant forms or through any email or communication channel on the Platform.
3. The Platform shall use your content for its operation and propagation according to the agreement of use or the information confidentiality agreement or for any purpose which is deemed proper and legal.
4. You confirm that you are the owner of any rights in this content and that the owner of these rights including the moral ones had completely and legally assigned these rights and transferred rightly and irrevocably them to the Platform.
5. Through the Platform, this content shall not be accessed, stored, reproduced or used by any third party as deemed proper by the Platform.
6. “Vehicle &” reserves its right to:
1. reject the circulation or presentation of any published content on the Platform.
2. its transmission
3. its omission.
7. “Vehicle &” seeks to update the Platform on regular basis and change it at any time. Nonetheless, any part of the content may be expired with no liability on our part for updating it.
5. Access to the Platform & its Links
1. The right to have an access to the Platform is temporary and revocable without any prior notice. The Platform is entitled to withdraw or amend the right of accessing to the Platform with no prior notice.
2. In case of the suspension of the service on the Platform for any reason or period, vehicleand shall not be liable for any compensations.
3. You have the right to extend link to your website which may serve the Platform for having an access to any published materials therein provided it shall be through legal method which shall not be used to the detriment of reputation of vehicleand or any of its subordinates. In case of your violation, the Platform shall take all the legal measures.
4. We do not permit you to insert a backlink of our Platform in such a way which may indicate in any way that you are affiliated to us, or have been approved or certified by us, and you must not insert a hyperlink in misleading manner in such a way as to indicate that such affiliation, approval or certification exists with vehicleand or any other entity.
5. We reserve the right to claim for cancelation of any backlink of our Platform or withdraw or amend the above referenced backlinks without any prior notice. The Platform or the website in which these backlinks are inserted shall comply with the standards of use as per the conditions of use. Such backlink shall not include systematic faults.
6. You shall not use the browsers of the electronic network such as robot spider and scraper for having an access to the content for any purpose or coping or entering it. An exception of this rule is accessible to the search engines and noncommercial archiving entities rather than to the applications of the websites which include any form of prepaid advertisements.
7. You shall not use any software for automatically publishing the advertisements on the Platform. Your advertising shall be manually published.
6. Links to other Websites
1. Whenever the Platform has links with other websites or sources, these links shall be provided for your information or for facilitating the service which is provided for you, we have no control over these websites or sour, we shall not be liable for any consequential loss or damage due to their use.
7. Prominent Advertisements
1. Vehicleand provides a service called "prominent advertisements", through which the users may pay the service fee for publishing their ads in selected pages on the Platform for the potential increase of the viewers.
2. For its use, the advertiser shall pay the fee of the prominent service which shall not be refunded except in case of the absence of such service from the Platform.
3. Before sharing in the prominent advertisements service, you shall be aware of its benefits. Upon sharing and payment of the fees, you shall be deemed approving the benefits which you shall receive.
8. Agreements, Use Conditions for Agencies & Exhibitions
1. The Platform provides incentives and offers to tradesmen, exhibitions and agents in the advertisements in which their capacities as agents or authorized exhibitions shall be included.
2. For easy access to the nearest agencies and exhibitions according to the geographical location, the agents and exhibition owners shall be linked with the interactive map of tradesmen.
3. The exhibition owners and agents shall be given priority for upgrading the rates of viewing for the accounts of juristic persons.
4. For registration of the juristic person (exhibitions, agents and tradesmen), copies of the legal and formal documents which are approved by the Commercial Registry in Saudi Arabia and the legal position or authorization of the advertising entity and representative of the juristic person shall be uploaded. The account shall be activated upon its approval by the Platform administration.
5. The Platform may accept and operate any account for any tradesman, exhibition or agency and vice versa without giving any reasons.
6. For any juristic body which is registered in the application as per its formal documents forwarded to the Platform administration or to the representative of the juristic body, it shall not be entitled to assign its account in vehicleand to any third party.
7. In case of any manipulative practices by an account to the Platform including creation of fake, noninteractive and unrealistic accounts, the Platform shall be entitled to cancel the account, which shall have no dues whatsoever.
8. The Platform shall be entitled to cancel any account which, at its sole discretion, had illegal and offensive content including threat, defamation or propagation to obscene or immoral actions or undesired contents or infringing upon intellectual property of any party or violating the general and particular terms and conditions of all the accounts.
9. The Platform may omit or suspend the inactive or noninteractive accounts no later than 30 days as of the date of the last activity, which no user shall object to ultimately.
10. All the formal data and approved guidelines, which we receive from the agents and exhibition owners shall be confidential and shall not be transferred to any third party. We shall maintain your data as long as your account/advertisement is valid and survived after the closure of your account and expiry of your advertisement which may be catalyst for fulfilling our legal and accounting requirements and reporting.
11. Any corporate body shall not be entitled to register at vehicleand in two accounts or advertise twice for the same vehicle
12. The advertiser shall comply with the legal rules in the E. trade system. The Platform shall be fully discharged of any liabilities for your advertisement before the official authorities. In case of your violation to the detriment of the Platform, you shall be accountable and we shall claim for compensation accordingly.
13. As an advertiser, you are well aware of the executive regulations' reference to the guide of the consumers' rights of the Ministry of Trade and most particularly of the advertisements, which include but are not limited to the following:
a. The electronic advertising shall be prohibited for any trademark, which the tradesman has no right to use or for fake trademark.
b. The electronic advertisement shall include the product's name, tradesman name, and means of communication, which were inserted in the spaces of uploading the advertisement on the application.
c. The commercial advertisements and their specifications and offers shall be binding upon the tradesmen and be part of the contract.
d. Any fake claim, which may cheat the viewer of the Platform, shall be forbidden.
e. Any statement that it is an advertising material.
f. Users may have an access to reject the receipt of advertisements.
14. The Platform shall not be liable for the content of any of the offers of the agents, exhibitions for their representative trademarks. It shall be fully discharged of any acts or omissions in the contents of offers or the descriptions in their ads. The Platform users shall communicate with the advertiser for the receipt of all the relevant particulars and verifying their soundness before buying the commodity.
9. Conditions of Use (for individual users).
1. The persons under 18 are not entitled to register in or use the Platform.
2. In case, the name is a tradename or trademark, you shall be the owner of the trademark or authorized to use it.
3. The user is accountable for the maintenance of privacy and limited access to its own account or using it along with the password, all the activities which are made in the name of the account and its password over and above all the actions pertaining to the use of its account.
4. In case of any unpermitted use of password or the user's account or violation of the standards of the safe use of the internet, the user shall forthwith notify the Platform.
5. You shall submit all your actual and present particulars and your use of the services as is specified by vehicleand.
6. The user shall respond to the Platform's requests for having additional information about your competence and use of our services.
7. In case of the change of the number of your mobile phone or its loss, you shall upgrade the number of your mobile phone.
8. The Platform visitors or users shall not pay any funds for the owners of the advertised vehicles before being verified of soundness of the advertisement, the proper legal condition of the vehicle and property thereof.
9. For all the data in the advertisements or the personal details of the member, the instructions of Islamic sharia, laws and traditions shall be respected.
10. The information in vehicleand is for personal use only.
11. The user shall not publish, send, provide any content through the Platform which may be rejected by vehicleand or contradictory to the valid rules and regulations, otherwise the user shall be accountable. In particular, you shall not publish, send, provide any content through the Platform in case this content is:
a. illegal, false, inaccurate, manipulative, defamatory, fraudulent or commercial for unpersonal, unpermitted, harmful, threatening purpose or slandering or any harmful information which may be conducive to the cancellation of the user's membership or its content.
b. impersonating any other person whom you are not entitled to get involved or any fake or robbed materials.
c. not relevant to the topic of discussion in which this content is published.
d. shows the same commodity or service in more than two items.
e. provides inconvenient or undesired messages or what is called Pyramid or Ponzi schemes or the undesired email Ads through this Platform or communicating with vehicleand or with any other users of the Platform.
c. includes any computer viruses or hacking software like trojan horses, computer worms or any other technically harmful materials. The perpetrator of these actions shall be held accountable for the financial and moral compensations with no liability whatsoever upon the Platform.
d. the content has political nature / critical of any government or municipality officials within a district.
e. the content violates any international, federal, national or local laws pertaining to the copyrights, patents, trademarks or any other laws of the intellectual property rights which are valid in Saudi Arabia.
f. the content has obscene nature and includes any forms of nudity or express sexual contents.
f. the content opposes or underestimates Islam in any form.
g. the content has racist or discriminative nature to any sect, religion, nationality, sex or any other groups.
h. the content includes information which may personate any other person without permission or uses manipulative addresses for hiding its actual source.
i. it delays the natural flow of the data through sending excessive messages and represents sale of illegal stuff according to the Platform or any law or regulation within the district in which or to which the product is sold or any other non-sale location.
j. the content is sent through email to another user on the Platform unless it is plainly stated to be communicated in case the sent content is not contradictory to the Platform terms and conditions.
k. the content includes any links to other Platforms or websites.
l. the content violates the valid rules and regulations in Saudi Arabia or in your homeland along with the trade systems and E. dealings.
10. Conditions of Adding Content
1. The advertised vehicles and machines shall comply with the conditions and permitted content of the Platform according to the terms and conditions.
2. The advertisement shall be in the proper section, detailed and including real and sound data.
3. At its sole discretion, the Platform may cancel, conceal or amend any advertisement without giving reasons
4. Prior to advertising, the vehicle shall fulfill all the permit and license requirements of the official authorities.
5. The photos which are used in the advertisement shall be equivalent to the advertised commodity on the Platform.
6. The photos shall be decent, of high quality and complying with the official regulations, human rights and all the government authorities.
7. Adding more than one advertisement for the same commodity is forbidden, the advertiser shall add one advertisement for each vehicle including clear photos for the same advertised vehicle. The Platform is responsible for processing the advertisement.
9. The user and advertiser shall remain the exclusive responsible for any of their published or amended advertisement. In case of amending the advertisement, it shall be controlled by all the relevant conditions, laws and controls. The user shall be responsible for any violations in all forms of the advertisement (whether updated or amended).
10. For avoidance of suspicion, the table of contents and the above referenced contrabands are not conclusive, vehicleand reserves its right to erase, with no further notice, any content which, at its sole discretion, is rejected or contradictory to the valid rules and regulations. The individuals who attempt to publish contents or act in violation of this clause shall not have an access to the Platform. In case of the existence of any breached contents, if any, the Platform shall be fully discharged.
11. The prohibitions upon your advertising for vehicles on the Platform
1. Exhibiting stolen vehicles.
2. Exhibiting vehicles which the user does not own or unlicensed by its owner for any exhibition.
3. Publishing indecent information, contents or news according to the recognized practices.
4. Publishing information which, at our sole discretion, are fake, erroneous and manipulative.
5. Publishing notes, questions, responses which are unrealistic including but not limited to the racist comments, assaulting another user, humiliating other cultures or any other offensive comments.
6. Publishing information which, at our sole discretion, imparts critical political opinion of content which is detrimental to the public interest.
7. Most of the methods of the forbidden advertisements including but not limited to the following:
a. irrelevance to the available buying, sale, services on the Platform.
b. suggestion or discussion of an issue with the administration on the Platform.
c. conciseness of the content.
d. bad quality.
e. lack of the advertiser's interest in communicating with those interested in the exhibited commodity.
f. advertising in wrong section.
g. adding photos other than those of the exhibited commodities
h. reference to any racist issue in all its forms
i. existence of erroneous information whether in deliberate or undeliberate form.
j. advertising for defamation purposes.
k. irrelevance of the title to the content.
l. copying an ad of another advertiser or any part thereof.
m. the general advertisements where there is no reference to the commodity or service.
n. ads of donating or for any assistance or mediation.
o. advertising for contributions or subscriptions.
p. the ads which entail abuse of power.
q. advertising in the post comments.
r. the content or the materials which are completely unethical or unreligious.
12. Most of the forbidden comments
a. advertising in the comments.
b. disparagement.
c. cursing with or without reason
d. lack of interest in buying.
e. the comments which are irrelevant to the advertisement.
f. underestimation of the commodity or the advertiser.
12. Forbidden Uses
All the following uses shall be forbidden:
1. Using the Platform for creation, verification, ascertaining or amending your databases and identification materials or those of any third party.
2. Using the services in case you become incompetent for their use or your incapacity for conclusion of binding contracts or the suspension of your account on a temporary or indefinite basis.
3. Committing any action which may underrate the Platform and the classification systems.
4. Transferring your account to any third party without reporting to the administration of the Platform and obtaining our prior approval in writing.
5. Breaching the Law, circumventing any of the techniques of the provision of services, transgressing the rights of third parties or our systems, policies and resolutions or those pertaining to your account.
6. Using any automated software, operation, robot, web crawler, extraction of the data or phishing or any of the screen scrapping software, operations, programs or systems.
7. Communicating with the unwelcoming persons or harassing, annoying or chasing the other users on the Platform.
8. Interfering or attempting to interfere in the transactions on the Platform or in the lists or the advertisements of the other users or the unpermitted access to the Platform or its server or any related computer or database.
9. Attempted hacking of an account of another user or any manipulation practices on the Platform, the users' accounts or their own fields.
10. Fabricating a claim on the Platform or causing complete or partial loss to the internet operators' services or any other service providers.
11. Making any action which may (in our viewpoint) have tremendous and unjustifiable burdens upon our infrastructure and operation policy.
12. The information may not be reproduced or copied for accelerating the action of any other Platform or website for commercial or informatic reasons including the advertisements. The user may not use vehicleand or reproduce any content for any purpose without the approval in writing.
13. Using unrealistic or inappropriate names or ambiguous letters or numbers in the registration process.
14. Disclosing the contact information to third parties (except what is required or specified by us) through the provided services for you.
13. Limitation of Use
1. Vehicleand, at its sole discretion, shall be entitled to set any limitations on your use of the Platform including but not being limited to the limitations on the period in which the content shall be presented on the Platform, the volume of each item in its content, number of the materials to be published. It shall be entitled to give no access for you in case of any breach of the conditions of use at any time without giving you any notice.
14. Enforcement of the Use Condition
2. Vehicleand reserves its right to take the steps which are deemed reasonably necessary and proper for verifying the fulfillment of these conditions including but not being limited to the cooperation in taking any legal action for your use of the Platform/ upon the claim of any third party that your use of the Platform is illegal or violates its rights.
2. You agree that vehicleand has the right to disclose any registration data / the information of the account to the law enforcement authorities, government officials or any third parties.
3. Vehicleand shall, reasonably and properly, verify the fulfillment of any of the use conditions including but not being limited the cooperation in taking any legal action for your use of the Platform/ upon the claim of any third party that your use of the Platform is illegal or violates the rights of these third parties.
4. The Platform shall share your data with the official authorities or upon their demands in case you are complained for your use of or benefit from the Platform.
15. Breaches of the Use Conditions
1. Vehicleand reserves its right to give you no access to the Platform, at any time without prior notice, in case of any breaches for use conditions.
2. Vehicleand reserves its right to omit any content which you add to the Platform at any time.
3. Vehicleand shall not be accountable to you or to any third party for the likely termination of your access to the Platform or omission of the content which you publish, thereafter; the user shall not use the Platform thereafter.
4. The Platform, subject to the user agreement and the rules and regulations, may resort to limiting your activity, removing your offers, omitting the lists of your vehicles which are set for sale, warning the other users in respect of your activities. Moreover, the Platform may resort, on a temporary or permanent basis, to limiting or withdrawing your membership, your access to the Platform without prejudice to its other rights and methods in any of the following cases:
a. Your breach of this agreement and the policy of use.
b. The Platform’s inability to authenticate any of your information submitted thereto.
c. Your activities may cause legal disputes and conflicts to you, other users or to the Platform.
d. The Platform may, at its sole discretion, reinforce the activity of the suspended users due to their incapacity for registration or reactivation on the Platform pending the permission thereof. Nonetheless, if you breach this agreement, the Platform reserves its right to recover any due funds or any losses or damages caused by you. The Platform, as it deems proper, has the right to take legal actions for bringing criminal and human right actions against you before the courts of Saudi Arabia
e. Your breach/ the breach of any third parties of this agreement shall not prejudice the right of the Platform to take the proper measures for such breach events.
f. The buyer shall assess the advertiser in a fair manner upon the completion of the sale.
16. Disclaimer Provisions
1. As permitted by Law, the Platform, its personnel, directors, agents and subordinates shall not be liable for any direct loss or failure due to your use of the Platform. In case, you are not satisfied with the Platform, its content or method of its use, you shall suspend its use. In all cases, your continuation on the Platform shall be deemed an agreement to its policies and method of its use. Moreover, you are aware that any illegal use of the Platform and its services shall cause damage to the Platform, in such case, the Platform shall enforce this agreement.
2. Vehicleand or any user shall not be accountable for any direct or indirect material or moral damage due the use of this Platform, whether due to the incorrectness of the information which were delivered by the users, or any delay or suspension for any reason.
3. The Platform is a communication and advertising channel where the users may interact for selling or buying their vehicles.
4. Vehicleand shall not be involved in any transaction by the seller or buyer using the Platform.
5. The Platform shall not guarantee that the transaction is completed by the buyer or seller or that the seller may repay its price. For the maintenance of the rights of each party, both parties shall authenticate the legal documents.
6. The user declares and agrees that vehicleand shall not be liable for any action by the users in terms of the contents, actions, reactions, the vehicles or the information they are exhibiting.
7. The Platform shall not be entirely liable for any agreement between the users, transfer of the legal property of any vehicle from the seller to the buyer. It has no right, authority or interest in any transaction or any relevant claims.
8. The Platform shall not be liable for any unsatisfactory or delayed performance by any of the two parties, or any loss or delay due to unavailable vehicle or whose delivery is delayed.
9. The Platform shall not be involved in any mediation or settlement of any dispute or controversy between the users.
10. The Platform shall not control or guarantee the quality, safety or legality of any advertised vehicle in terms of its parts or the buyer's payment of its price.
11. Prior to the vehicles' sale or buying, both the seller and buyer shall be liable for verifying their standards, value and extent of their market merchantability.
12. The Platform is not a supplier or a manufacturer of any of the vehicles which are sold or bought on the Platform.
13. The Platform does not represent or guarantee the users in terms of their credibility or identity.
14. The Platform is not involved in any auto sale business or may act as intermediary in the payment of the vehicle's price. In case of any request by third party for your payment of the vehicle's price or its transfer to the interest of the Platform, you shall forthwith report to the Platform.
15. The user hereby discharges the Platform of the consequences of the content or the existence of such links on the Platform.

10. This Platform is delivered to you on as is basis. Accordingly, vehicleand dismisses any warranties or guarantees, whether oral or written, explicit or implicit or created according to the law or tradition, trade practices in respect of the Platform or any services through it. Without prejudice to the generality of the foregoing, the Platform denies any guarantee for the following:
Any implicit guarantees or conditions for the rights of property of any service or commodity we have from any third party or for its marketability.

2. Any failures in the sold vehicles before and after sale.
3. The Platform is fully discharged of guaranteeing any part in the sold/bought vehicle through the Platform.
4. Any failure upon checking the vehicles during the sale/buying process,
5. Any failure or damage of the guaranteed parts due to the replacement, adjustment or installation of special parts like the sport filters, kit pack or any part which is not compatible with the design of the manufacturing company.
6. Any liability in the cases of death, bodily injuries, breakdown of properties or any failures due to direct or indirect natural factors due to use of any vehicle which is exhibited on the Platform.
7. Any repairs, failures, damage, legal liability which is claimed under any valid insurance, guarantee or surety.
8. Any direct consequences as a result of hostilities, invasion, foreign aggression (whether war is declared or not), civil wars, rebellion, revolution, armed rebellion, military action, usurping by force.
9. Greasing, filters, antifreeze, refrigeration or any action due to excessive temperature, frost, corrosion, decrease of the oil levels or cooling liquids or any leakages which are not covered.
10. The parts like the batteries, tires, plastic parts, frame, dyes, discharge system, glass, internal fittings, and decoration.
11. The normal replacement of the service parts: spark plugs, wiper blades, fuses, electric valves, (brake pads, clutch, camshaft drive, PVC valves, axes, filters, nozzles, spark plugs, light bulbs, fan belt and the other parts subject to tear due to use, etc.).
12. Damage, rust due to normal use of the painted parts, plastic parts, upholstery and smooth decoration.
13. Any problems due to excessive use, insufficient maintenance, negligence, exposure to an accident or ill-use.

14. Any guarantee, spare parts/ parts or maintenance services or spare parts which the customer changes as part of the routine maintenance services according to the guidelines of the manufacturing company.
19. Disclaimer of (The Platform Content)
1. The Platform is not liable for any content which is submitted by the users and published in or sent through or connected with the Platform and through which the rights of property of any other user are fringed upon and in all cases cannot be deemed reliable documents.
2. Vehicleand is not introduced as a promotor and shall not be accountable for any dealings between you and any other user /users of other Platforms.
3. Subject to these conditions, vehicleand certifies that it does not control, verify or approve the content, as you are liable for assessing any content which may be published on the Platform in terms of the extent of its accuracy.
4. Vehicleand is fully discharged of the involvement as a party in any dispute between the user and other user/s on the Platform.
5. In case of your breach of the laws of Saudi Arabia or the conditions of the service use, the rights of privacy of the personal data may be lost or disclosed. In such case, the Platform shall be discharged of such breach.
20. Disclaimer of any Damages
1. According to these conditions and the greatest extent which is permitted by the valid law, vehicleand dismisses any liability for any damages including but not limited to the direct, indirect, special, disciplinary, causal and consequential damages and losses which may be inflicted upon any user of the Platform, or in respect of its use, inability of its use or the consequences of its use.

Any other Platforms or websites which are connected with it or any published materials thereon and, without limitation, any liability for loss of income, revenue, work, earnings or contracts, loss of expected savings, loss of data, loss of good faith, waste of office hours, any other loss or damage, whether due to an offense including negligence, breach of the contract, regardless if this may be expected.
3. Most particularly, vehicleand shall not be liable for any damages or losses which may be inflicted upon you or any third party as a result of:

22. Payment & Cancellation
1. Services: different unique packages shall be bought and be accessible through different pages on the Platform. All the rates shall be in SR.
2. Whenever necessary, the fees of the advertising services shall be prepaid in which case we shall forthwith provide the service.
3. We do not receive any service fee for the sale of the vehicles and machines which are advertised for on the Platform but we receive the advertising fees.
4. The advertiser shall pay the advertising fee (if any) so as to have an access to the service and to publish the advertisement thereof.
5. Payment: we shall receive all the full amounts due before the start of the service. The accepted methods of payment are: PayPal, apple pay, Visa and Mastercard. You shall be liable for paying any current or prospective taxes (except for the vehicleand net income-based taxes) which are applicable to the following services. The paid amounts are non-refundable.
6. Cancellation & Refund. All the amount refund claims shall be checked on case-by-case basis and shall be paid at the sole discretion of vehicleand and through the original payment method. The user agrees that no amounts shall be refunded for any actually finished services. Absolutely, no amounts which were paid for published services shall be refunded.
7. Information of the credit card: the collected data do not include the details of the customers' credit card. All the information of the credit card shall not be stored, sold, shared or leased in general or to any third party.
8. The Platform shall be entitled to amend the operation fees; any amendment shall be declared to your email. Such amendments may be temporary or permanent.
23. Applicable Law & Settlement of Disputes between the User & vehicleand
1. These conditions of use are governed by the Laws of Saudi Arabia with the exception of any rules which mandate the selection of laws.
2. In case of the occurrence of any dispute between you and vehicleand, it shall be initially settled by amicable means.
3. In case of the failure of both Parties for settling the dispute by amicable means, each Party may refer it to the judiciary authorities which shall be in the competent court in Dammam City.
24. Dispute between Users
1. Vehicleand shall be governed by the agreement of use, we are not a party in any dispute or lawsuits between the users for their violation of the use agreement. What concerns us is the security issue of the Platform for limiting or eradicating the infringements of some of the Platform users in violation of the agreement, policy, privacy and conditions of the use for the integrity of the businesses, fighting fraud, cheating, deception and following the applicable and valid laws, legislations and regulations in Saudi Arabia.
2. Accordingly, the Platform shall be entitled to take action against any individual, corporation or company which violates the agreement of use which may take the form of prosecution before the judiciary circuits. We refer herein to the common breaches and necessary actions.

In case of adopting of an individual, corporation or company of illegal actions as hacking or using illegal data collection methods for accessing the Platform content, programing the website, application or the databases of the Platform or the information and data of its customers for copying, republishing them and using them in any way: vehicleand shall report to the competent authorities for litigating the other party on the ground of hacking and committing the crimes of violating the informatic crimes' laws.
In case of copying an individual, corporation or company of an advertisement of vehicleand: vehicleand shall take the necessary actions, report it to the competent authorities, and prosecute the other party for infringing upon the rights of the Platform/company.
Infringing upon the rights of intellectual property /patent of any third party: you shall contact us and submit any supporting evidence in the published advertisement, vehicleand shall consider the complaint and take action accordingly. In case of your interest in any litigation measures against the infringing party, vehicleand shall not be involved in any lawsuit.
Exposure to defamation and trespassing upon the personal privacy: the complaint shall be reviewed and monitored; the trespassing party shall be reported. The victim shall submit the complaint to the competent authorities, vehicleand shall not be involved in any lawsuit except for submitting the necessary data to the competent authorities
25. Reporting of any breaches
1. You are advised to report to us in case of the existence of any violations by any third parties in terms of these use conditions, which, at your discretion, may be infringing upon your property rights or those of any third party.

26. General Provisions
1. This agreement is executed according to the Law of Saudi Arabia; it is governed by the legislation which is valid in the courts of Saudi Arabia. In case, there are articles which are incompatible with the laws of Saudi Arabia or some of these articles were cancelled by the competent authority, these canceled articles shall be rectified according to the updated systems and legislations and the remaining articles in the agreement shall remain valid.
2. You agree to all the terms and conditions and the conditions of use executed on line without prejudice to their legal efficiency and obligatory nature.
3. This agreement was prepared and published in different languages; Arabic is the approved version. In case of any discrepancy between the Arabic version and of any other languages, the Arabic version shall prevail.
4. The terms of use constitute the entire agreement between you and vehicleand, it supersedes any other agreements, warranties, understandings, oral or written current or past discussions between you and vehicleand, whether explicit or implicit.
5. The delay of vehicleand or its non-exercising of any right or taking action against any breach of the terms of use shall not be considered as assignment of exercising it in the future.
6. These conditions of use are divisible, in case there is illegal or inappropriate provision according to any of the valid laws, this provision may be changed to the extent logic that may render it legal, proper and binding.
7. You shall not dispose of any of the conditions of use except by express permission of vehicleand. As for vehicleand, it may dispose of these conditions immediately upon publishing a relevant notice on the Platform.
8. The user's agreement shall not include any reference to any partnership between you and the Platform and you have no authority for binding the Platform.
